The deal

1. What this is

Still Fits is a marketplace where families hand down outgrown spirit wear. We are not the seller. When you buy something here you are buying it from another member; we run the site, take the payment and pass it on.

2. Your account

1. You must be 18 or over. The gear belongs to your family; the account is yours. Stripe requires an adult account holder for payouts, and so do we.
2. One account per person. Give us a real email address — it is the only way to sign in.
3. Anything done through your account is treated as done by you, so do not share the link we email you.
4. You can close your account whenever you like by emailing us.

3. Listing something

1. List only things you own and are allowed to sell.
2. Describe them honestly — size, condition, and any damage. A photograph of the actual item, not a catalogue picture.
3. No counterfeits, no items bearing marks you have no right to sell, nothing unsafe, and nothing that is not spirit wear or team equipment.
4. Do not identify a child. No names, no numbers on a nameplate, no year group, no photographs of children. Photograph the garment.
5. We can remove a listing or suspend an account if any of the above is not met. We will tell you why.

4. Buying

1. Placing an order is an agreement with the seller, not with us.
2. Pay through the site. Paying a seller off-platform is at your own risk and outside anything we can help with.
3. Most trades here are hand-to-hand at a practice or a game. Arrange that between yourselves, sensibly, in public.
4. If a listing charges for postage, you give a delivery address when you pay, and the seller can see it — they cannot send the item otherwise. Nothing is asked for on a listing that is not being posted.
5. When an order is paid, you and the other person can see each other's email address, on that order, and we email you both. There is no messaging here, so that is how a handoff gets arranged. Use it to sort out the trade and nothing else — it is not a mailing list.

5. Fees

1. The buyer pays the item price plus 15%. The seller receives the item price minus 5%. Both are shown before you commit.
2. Fees apply to the item price only. Postage passes to the seller in full.
3. Free listings carry no fee at all, on either side.
4. If we change these, we will say so before it applies to anything you list or buy afterwards. It will never change the price of an order already placed.

6. Payments and payouts

1. Payments are processed by Stripe. Using the site to sell means also accepting Stripe's Connected Account Agreement.
2. Still Fits is the merchant of record. Your card statement will say Still Fits, not the seller's name.
3. Sellers are paid by Stripe on a daily schedule once Stripe has verified their details. We do not hold your money and cannot release it faster.
4. You are responsible for your own taxes on what you earn. Stripe reports earnings over federal and state thresholds.

7. When something goes wrong

1. Email [email protected] first, and give the other person a fair chance to put it right.
2. If an item never arrives, or is materially not as described, we will refund the buyer and recover the amount from the seller's payouts.
3. Buyer's remorse is not a refund. These are secondhand clothes; a jersey that fits differently than hoped is not a fault.
4. A refund returns what your card was charged. If you used credit on that order, the credit goes back to your balance too — the card refund is already net of it, so you are not left short.
5. A chargeback raised with your bank without contacting us first costs everyone more and helps the seller least.

8. Invites and credit

1. Everyone gets an invite link. An invite earns credit only once the person you invited has actually bought or sold something — not when they create an account.
2. It has to be a real trade to count: an item priced at $10.00 or more, between two people who are not already connected to each other through an invite. A token sale, or postage on a free item, earns nothing.
3. Credit is not money. It reduces the service fee on your own purchases. It cannot be cashed out, transferred, or used to pay a seller, and it expires with your account.
4. If an order is refunded, the credit it earned is taken back from both sides. If it has already been spent, the balance goes below zero and future discounts are withheld until it is level again. You will never owe us money because of this — the only thing a negative balance can do is postpone a discount.
5. Inviting people who are not real, or arranging purchases in order to collect rewards, ends the account and the credit with it.

9. What we do not promise

We do our best but we are a small site. We do not guarantee that it will always be available, that a listing is accurate, or that another member will behave well. We do not inspect items and we are not present at a handover.

Where the law allows us to limit what we owe you, our liability is limited to the fees we charged you on the order in question. Nothing here limits anything that cannot legally be limited.

This paragraph in particular is one a lawyer needs to look at before launch.

10. Schools and teams

Still Fits is not affiliated with, endorsed by or sponsored by any school, school district, club or athletic association. Names are used to identify a community and for nothing else. We use no school logos, marks or uniform designs, and the colours on the site are approximations we chose. If you represent a school and want something changed, email us and we will.

11. Changing these terms

If we change anything that materially affects you, we will email you before it takes effect. Carrying on using the site afterwards means you accept the change; if you do not, close the account.

12. Law

These terms are governed by the laws of the State of Alabama, and any dispute belongs in a court in Jefferson County, Alabama.
